Abstract: O presente trabalho teve o objetivo de elaborar um diagnóstico dos passivos ambientais existentes em áreas legalmente protegidas, como Áreas de Preservação Permanentes (APP) e Reservas Legais (RL), dos imóveis rurais impactados com a deposição de rejeito de mineração da barragem de Fundão da Samarco. Estes imóveis estão localizados às margens do rio Gualaxo do Norte. Para tanto, utilizaram-se dados de 174 imóveis rurais declarados no Cadastros Ambiental Rural, obtidos a partir do download das bases disponíveis no Sistema Nacional de Cadastro Ambiental Rural. Foram selecionados todos os imóveis com área inferior a 4 módulos fiscais e os imóveis com áreas superiores nos quais foi possível identificar alguma atividade agrossilvipastoris, por meio da análise de imagens de satélites. As áreas desses imóveis abrangem 6,7 mil hectares. Pôde-se aferir que 91% destes imóveis possuem áreas menores que quatro módulos fiscais e representam 41% da área total avaliada. As áreas cobertas por remanescentes de vegetação nativa totalizam 31% e as áreas declaradas como consolidadas 59%. Dessa área total, 18% são APPs, cerca de 1,2 mil ha. Parte dessa APP está coberta por vegetação nativa, aproximadamente 36%, a outra parte, cerca de 338,13 ha, deverá ser obrigatoriamente restaurada. O restante da área da APP, 421,22 ha, permanecerá em uso, no caso dos pequenos imóveis rurais. As RLs declaradas somam uma área de 19%, equivalente a 1,3 mil ha. 81 possuem déficit de RL, sendo que somente 4 possuem a obrigação de recompor 80,82 ha. Os demais imóveis, menores que 4 módulos fiscais, estão dispensados da recomposição de 115,27 ha por regras estabelecidas pela legislação em vigor. Desta forma, concluiu-se que, para atender as disposições do Decreto Estadual 48.127/2021 que regulamenta o Programa de Regularização Ambiental – PRA, a restauração florestal deve ser implantada logo no primeiro ano em uma área de 186 ha e os demais passivos em APP nos próximos 5 anos. Assim, pôde-se estimar que serão necessárias cerca de 603 mil mudas, caso fosse realizado somente o plantio direto de espécies nativas. Portanto, fica evidente a necessidade urgente de criar oportunidades para a restauração florestal, uso de técnicas não onerosas para os pequenos produtores rurais, sistemas agroflorestais e regeneração natural, fomento à criação de viveiros de mudas pela agricultura familiar e incentivo fiscal para comercialização de produtos florestais.
metadata.dc.description.abstracten: This study aimed to prepare a diagnosis of environmental liabilities existing in legally protected areas (APPs) and Legal Reserves (RLs), of rural properties impacted by the deposition of mining tailings from Samarco's Fundão tailing dam. These properties are located on the banks of the Gualaxo’s do Norte River. For this purpose, data from 174 rural properties declared in the Rural Environmental Registry (CAR), obtained from downloading the databases which are available in National Rural Environmental Registry System (SICAR). All rural properties smaller than four fiscal modules and the rural properties larger than four fiscal modules where it was possible to identify any kind of agriculture, livestock and forestry activities, via satellite imaging, were selected. The sampled areas, covering an area of 6.7 thousand hectares.It could be inferred that 91% of these properties have areas smaller than four fiscal modules and represent 41% of the total evaluated area. Areas covered by remnants of native vegetation comprises an amount of 31% and areas declared as consolidated an amount of 59%. Of this total area, 18% are APPs, around 1.2 thousand ha. Part of this PAs is covered by native vegetation that corresponds to approximately 36%, the other part, about 338.13 ha, must be restored. The remaining area of the APP, 421.22 ha, will remain in use only for the case of small rural properties. The declared RLs totalize an area of 19%, equivalent to 1.3 thousand ha. Of the 174 properties analyzed, 81 have a RL deficit, and only 4 have the obligation to restore 80.82 ha. The other properties, smaller than 4 fiscal modules, are exempt from the recomposition of 115.27 ha by rules established by the current legislation, such as respect for human occupations consolidated in these protected spaces and the continuity of agroforestry activities. Accordingly, it can be concluded that to comply with the provisions of State Decree 48.127/2021 that regulates the Environmental Regularization Program (PRA), forest restoration must be implemented in the first year in an area of 186 ha and the other liabilities in APP in the next 5 years. Therefore, it can be estimated that around 603 thousand seedlings will be needed if only the direct planting of native species were carried out. Thus, the urgent need to create opportunities for forest restoration, use of inexpensive techniques for small rural producers, agroforestry systems, and natural regeneration, fostering the creation of seedling nurseries for family farming, and tax incentives for the sale of forest products.
