Resumo: A pesquisa investigou os temas controle social e accountability em leis estaduais que normatizaram a utilização das Organizações Sociais – OS’S, no campo educacional, buscando construir uma interpretação sobre a possibilidade desses dois elementos interagirem com o conceito de gestão democrática na educação. Objetivou-se, assim, responder à seguinte pergunta de pesquisa: o que os marcos legais estaduais de Organizações Sociais sugerem em termos de controles democráticos e accountability e seus possíveis efeitos sobre a área educacional? Trabalhou-se com a hipótese que a sociedade civil organizada no âmbito das Organizações Sociais possuía configurações distintas dos movimentos sociais da transição democrática. Com isso, a possibilidade de oferta educacional por meio destas entidades colocava em questão a própria lógica de controle social e accountability uma vez que os atores responsáveis historicamente pelo exercício do controle social, qual seja, a sociedade civil, passa a ser a provedora pela oferta da educação, levando a um impasse traduzido na indagação “quem controla os controladores”? Sendo assim, o objetivo do trabalho foi investigar o alcance das leis estaduais nos estados de Goiás, Minas Gerais, Paraná, Pernambuco e São Paulo, que implementavam os programas de publicização, com a utilização das Organizações Sociais, na área educacional com ênfase no controle social e accountability. Para isso, foi utilizada a investigação de natureza qualitativa, por meio da constituição de um banco de dados de documentos legais sobre o tema, posteriormente submetido à análise documental. Primeiramente, buscou-se entender o surgimento das Organizações Sociais no Brasil, através de propostas da Reforma Administrativa de 1995, que difundiram os ideais da Nova Gestão Pública como o gerencialismo, accountability, eficiência e descentralização, entre outros, com a publicação do Plano Diretor da Reforma do Aparelho do Estado, sendo este considerado o marco teórico e temporal da reforma, e sua possível expressão na educação. Empenhou-se também na realização da revisão bibliográfica em torno dos termos controle social e accountability. Ademais, foram realizados o mapeamento e a “unitarização” dos marcos legais estaduais e de decisões dos Tribunais de Conta em torno das OS’s. A partir de uma profunda revisão da literatura sobre controle social (Nassuno (1997), Levy (1999), Bresser-Pereira e Cunill-Grau (1999; 2006), Silva (2002), 8 Rezende (2002), Filgueiras e Araújo (2004), Arantes et al. (2005), Pacheco (2006), Arantes et al. (2010), Filgueiras (2018)); accountability (Campos (1990), O’Donnell (1997), Behn (1998), Bronzo (2004), Verschuere et al. (2006), Arantes, (2010), Filgueiras (2011), Rocha (2011) e Trubek et al. (2012)); gestão democrática na educação (Paro (1997), Libaneo et al. (2003), Luck (2006), Adrião e Camargo (2007), Freitas (2016), Souza e Pires (2018), Militão e Militão (2019)), foram construídas as seguintes unidades de análises: i. Conselho de Administração; ii. Controle horizontal de Tribunais de Contas; iii. Controle por Resultados; e iv. Accountability e Accountability societal. A análise das unidades permitiu concluir que todos os estados selecionados produziram sua legislação para a normatização da atuação das Organizações Sociais e, com exceção do estado de São Paulo, todos os demais estados previram a possibilidade da oferta educacional. Ao investigar possíveis estratégias de modo a melhorar o controle social e accountability, no cenário de oferta da educação por OS’s, não foi possível identificar instrumentos legais que contribuíssem para melhorar o potencial do controle social e accountability ou até mesmo da gestão democrática da educação, de forma a adensá-la ou aprimorá-la. Ainda que o Plano Diretor de Reforma do Aparelho de Estado - PDRAE tenha defendido o controle social e accountability como importantes ferramentas de utilização de OS’s, os marcos legais não traduziram essa defesa em termos de desenhos e dispositivos legais. Ainda que haja uma profunda alteração na possibilidade de oferta, de provisão estatal para provisão via sociedade civil, as leis não previram formas de controlar os controladores, ou seja, quem controlaria a sociedade civil na oferta de políticas públicas educacionais. As formas de controle encontradas na legislação examinadas preveem lógicas já constitucionalizadas como os Tribunais de Contas. Além disso, foi possível observar a figura de um “Conselho Administrativo” em todos os estados, repetindo a lei federal n˚ 9.637/1998, com exceção do Paraná que adotou o nome de Conselho Curador, mas que se propõe às mesmas funções do primeiro. A importância atribuída aos Tribunais de Conta nas leis estaduais levou a que o trabalho examinasse as Instruções Normativas e acórdãos produzidos pelos TC’s estaduais e da União de modo a compreender se essa instância havia proposto alterações nas formas e normas de controle social e accountability, tendo em vista a legalização da atuação dessas entidades em interação com o Estado, na condição de provedoras. Por fim, é possível afirmar que a legislação produzida pelos estados, bem como as instruções normativas do Tribunal de Contas não levam em conta instrumentos ou pressupostos já construídos e assentados na política pública brasileira como os Conselhos ou outras instâncias participativas, não podendo, assim, ser 9 constatada integração entre as propostas de controle social e accountability presentes na legislação que dispõe sobre OS’s e contornos de gestão democrática na esfera das políticas públicas em geral e da educação, particularmente.
Resumo em outra língua: This academic research investigated the subjects of social control and accountability in state laws that regulated the use of Social Organizations - SO’S, in the educational field, seeking to build an interpretation on the possibility of these two elements interacting with the concept of democratic management in education. As follows, the objective was to answer the following research question: what do the state legal frameworks of Social Organizations suggest in terms of democratic controls and accountability and their possible effects on the educational area? We worked with the hypothesis that organized civil society within the scope of Social Organizations had different configurations from the social movements of the democratic transition. With this, the possibility of an educational offer through these entities put in question the logic of social control and accountability since the actors historically responsible for the exercise of social control, that is, civil society, becomes the provider for the offer of education, leading to an impasse translated into the question “who controls the controllers”? In this manner, the principal objective of the work was to investigate the scope of state laws in the states of Goiás, Minas Gerais, Paraná, Pernambuco and São Paulo, which implemented the publicização programs (programa de publicização), with Social Organizations, in the educational area with an emphasis on control social and accountability. For this purpose, a qualitative investigation was handled, through the constitution of a database of legal documents on the subject, later submitted to documentary analysis. Initially, we sought to understand the emergence of Social Organizations in Brazil, through proposals from the 1995 Administrative Reform, which spread the ideals of the New Public Management like managerialism, accountability, efficiency and decentralization, among others, with the publication of the Master Plan of the Reform of the State Apparatus (Plano Diretor da Reforma do Aparelho do Estado), this being considered the theoretical and temporal landmark of the reform and its possible expression in education. We also endeavored to carry out a bibliographic review around the terms social control and accountability. In addition, the mapping and categorization of state legal frameworks and decisions of the Account Courts around SO’s were carried out. The analysis of the categories allowed us to conclude all the selected states produced their legislation to 11 standardize the performance of Social Organizations and, with the exception of the state of São Paulo, all other states foresaw the possibility of educational provision. Based on a thorough review of the literature on social control (Nassuno (1997), Levy (1999), Bresser-Pereira and Cunill-Grau (1999; 2006), Silva (2002), Rezende (2002), Filgueiras and Araújo (2004), Arantes et al. (2005), Pacheco (2006), Arantes et al. (2010), Filgueiras (2018)); accountability (Campos (1990), O'Donnell (1997), Behn (1998), Bronzo (2004), Verschuere et al. (2006), Arantes, (2010), Filgueiras (2011), Rocha (2011) and Trubek et al. (2012)); democratic management in education (Paro (1997), Libaneo et al. (2003), Luck (2006), Adrião and Camargo (2007), Freitas (2016), Souza and Pires (2018), Militão and Militão (2019)), the following categories were built: i. Administrative Council; ii. Horizontal control of Courts of Accounts; iii. Control by Results; and iv. Accountability and societal Accountability. The analysis of the categories allowed us to conclude that all the selected states produced their legislation to standardize the performance of Social Organizations and, with the exception of the state of São Paulo, all other states foresaw the possibility of educational provision. When investigating possible strategies to improve social control and accountability in the scenario of education provision by SO's, it was not possible to identify legally binding instruments that would contribute to improving the potential of social control and accountability or even the democratic management of education, in a way to densify it or improve it. Although the State Apparatus Master Plan for Reform has defended social control and accountability as important tools for using SO’s, the legal frameworks did not translate this defense in terms of designs and legal provisions. Although there is a profound change in the possibility of offering, from state provision to provision via civil society, the laws did not provide for ways to control the controllers, that is, who would control civil society in The provision of educational public policies. The forms of control found in the examined legislation provide for logics already constitutionalized as the Account Courts. In addition, it was possible to observe the figure of an “Administrative Council” in all states, repeating Federal Law No. 9,637 / 1998, with the exception of Paraná, which adopted the name of the Board of Trustees, but which proposes the similar functions as the first. The importance attributed to the Account Courts in the state laws conducted the work to examine the Normative Instructions and judgments produced by the state and Union Account Courts to understand whether this instance had proposed changes in the forms and rules of social control and accountability, taking into account in view of the legalization of the performance of these entities in interaction with the State, as providers. At the last moment, it is 12 possible to affirm that the legislation produced by the states, as well as the normative instructions of the Account Courts, do not take into account instruments or assumptions already built and based on Brazilian public policy, such as the Councils or other participatory bodies, and thus cannot be found integration between the proposals of social control and accountability present in the legislation that provides for SO's and outlines of democratic management in the sphere of public policies in general and education, in particular public policy, such as the Councils or other participatory bodies, and thus cannot be found integration between the proposals of social control and accountability present in the legislation that provides for SO's and outlines of democratic management in the sphere of public policies in general and education, in particular.
